3. Copyright, Restrictions and Use

graphics, sound, animations, logos, trademarks are the property of DMA Softlab
and/or its customers and are protected by copyright, trademark, patent and other
intellectual property laws. You may not use, modify, adapt, or in any way alter
these materials and contents without the permission of the author You are granted
the permission to download any article published on this site and reprint it
on your Web site or in your opt-in newsletter solely for your own non-commercial

well as in connection with all advertising, marketing and promotional material
related thereto. You agree that you shall have no recourse against DMA Softlab
for any alleged or actual infringement or misappropriation of any proprietary

4. DMA Softlab Payment Procedures DMA Softlab provides services and software products through Share-It.
Detailed conditions of payments are set in individual agreements. We accept
payments by wire transfer, credit card, PayPal etc. in all major currencies.
All necessary information like wiring instructions in case of wire transfer
are available through Share-It payment processing site.
5. Warranty of Services Warranty is applicable for services only (such as
network engineering etc.) and not for software products. DMA Softlab has to
correct any kind of problems free of charge on the built systems
up to 30 days after the works were finished, the whole amount
of the price of the service was paid and while the system remains untouched
by customers.
6. Refund Conditions and Money Back Guarantee The customer has right to request refunding the whole price of the
software product or the service (minus the transaction fee).
If the customer is not satisfied with the product,
he/she can ask DMA Softlab to refund the price of the software (minus
the share-it fees) up to 30 days after the purchase was done
and if the permanent license was not delivered yet (the trial license expires
within 30 days). After the 30 days trial period or if the permanent license
was delivered DMA Softlab will not accept any refund requests.
The customer can request refunding the price of the
service (such as network engineering etc.) up to 14
days after the system was realized, paid in full and if it was not
modified by the customer in any form. After the 14 days period DMA Softlab will
not accept any refund requests.
After a completed refund process the customer must destroy
the software product and / or the network (delete all settings on routers, servers
etc.) built / developed by DMA Softlab.
7. Software licenses DMA Softlab ships software products with a license key bound to the
hosting server (hardware and operating system). One software product can be
installed on a specific host only. The installed system and license cannot be
transferred to a different host without a permission from the software producer.
Hardware change / OS replacement / upgrade requires a new
license key.
There are two type of licenses available: trial
and permanent.
Trial licenses are used to test new
software installations. Trial licenses have time limitation of 30 days. The
Customer can request free of charge up to 5 trial keys for
a certain product (for testing the system before requesting a permanent license
key).
The Customer can request only one permanent
key for any product (one license key is included in the product price).
The Customer can purchase additional license key(s) for his own purpose only
(for 2nd, 3rd etc. host) on a discount price.
A license key will be issued for a real MAC
address only. DMA Softlab will not issue a license key for a cloned MAC address.
The Customer can request a replacement
licensekey if the hosting hardware has been damaged
or server upgrade is required. The processing fee varies from case to case and
it is 20-40% of the full price of the license.
To apply a replacement license key the customer has
to send a printed, signed and scanned statement to
DMA Softlab. In the statement the following have to be included:
-the reason of requesting a new permanent license key
(the hardware is damaged etc.)
-the old permanent license key has been destroyed and the old server has been
decomissioned
-the MAC address of the old, licensed interface
DMA Softlab reserves the right to decline any suspicious
license key replacement request.
8. Data Protection
DMA Softlab offers software installation services. If the customer requests
a such service, he/she must be sure to not store any confident documents on
the server before sending the system access data to DMA Softlab (usernames,
passwords, IP addresses). DMA Softlab will never share passwords, documents,
parts of documents or any data found on customer's host with 3rd parties and
will destroy all the system access data (usernames, passwords, IP addresses)
after completing the operation. DMA Softlab cannot be held responsible for any
damage or data loss during and after the installation procedure.
9. Disclaimer and Limitation of Liability The services and all materials described on this Web site are provided
on an "as is" and "as available" basis. DMA Softlab makes
no warranties of any kind to the operation of this site but does guarantee providing
quality services as described on this Web site. In no event DMA Softlab will
be liable for suitability, merchantability, or usability of products and services
developed and delivered. By using this site, you agree to indemnify, defend
and hold harmless DMA Softlab and its partners, affiliates, and customers against
any claim, demand, action, or other proceeding based on or arising from use
of the Web site, services, and any act made by yourself or your company.
10. Personal Information DMA Softlab has a very strict non-misuse policy and does not collect
any personal information on this Web site. Any personal information voluntarily
disclosed by you on this Web site will never be abused or sold to any third
party. All information is strictly confidential and will not be used for any
purpose other than to accurately serve you and your business.
11. Governing Law These Terms and Conditions shall be governed by, and interpreted in
accordance with the laws of the Delaware.
